2. Evaluate the following fact pattern. Do you think there is a cause of action, and how would you handle this case if you were the judge?
A young man who is an Olympic swimmer walks by a deserted lake and sees a small child drowning in the middle of the lake. He could easily save the child, but he doesn’t want to get his clothes wet so he chooses to keep walking and the child drowns. The family of the child sues the young man.
Would it change your analysis if the young man jumped into the lake, swam halfway to the child, but then decided he was going to be late to his girlfriend’s house and swam back to shore, leaving the child to drown?
